Summary

The declining condition of Indian masses is no more a secret. The Indian society is badly infected with evils like terrorism, provocations in term of protests and agitations as well as revolutionary movements that cause discontent against the established order. About 110 crore of the Indian population survives under highly impecunious living conditions. Agrawal (2019) in his valuable work ‘India in Chaos, Only Judiciary can Save’ suggests how the poverty- stricken and deteriorating masses can be rescued with the help of liable and accountable system of governance as a pre-requisite at the States and Union level. Indian masses have suffered a lot and have no strength for further exploitation and experimentation. The motto of good governance lies in addressing the causes of the problems at foremost priority. Keeping in view the solution of the problems, the author most specifically focuses the role of learned judiciary as how legal paternalism is required to be put into practice. To feel the pulse of the nation, judiciary is required to take up corrective recourse. Launching real time surveillance over the performing bodies is the need of time to grasp any form of defiance. In this way, all the system can be turned into an accountable and worthwhile arrangement.

‘India in Chaos, Only Judiciary can Save’ by K.C. Agrawal is a well-researched and well- analyzed piece of writing- an eye opener to the practical aspects of the issues facing by Indian masses. The book is cautiously divided into three parts to investigate the subject matter in a detailed and proper manner.

The crux of the Part 1 is to analyze thoroughly the perennial failures of the governing authorities. In India, more focus is always placed on economic and social reliefs, reservations, dole-outs and ever-rising quotas rather than tangible and constructive measures. The author realistically expresses how these reliefs result in eating up into our own resources, in the end of the day. The author further illustrates the highly crumbling state of the country where the guardians have badly clutched in achieving ‘Basic Objectives’ of the constitution under Part III and Part IV- Fundamental Rights and Directive Principles, respectively. It is obvious to understand that incumbency of a state is directly related to the well- being of the people.

Part 2 of the book tries to identify the causes of recurring failures. With the help of relevant explanations, the author systematically justifies how the short- term measures like reliefs and dole-outs are unwarranted and disgraceful for a nation in a long run. However, with the help of learned judiciary we can still strive to accomplish what we have lost. Being the custodian and the implementer of the constitution, the judiciary may rise to shake up legislative and executive bodies to shun parasitic practices and oligarchic tendencies. In addition, the author encloses various UN Resolutions, treaties, charters as well as some worthy constitutions with relevant provisions in detail to indicate the importance of human rights. While unfolding the uprising and civil wars round the globe, the author tries to communicate how the betrayal of the guardians and socio- economic regression may ruin the nation into fragments.

Agrawal also tries to point out some judicial verdicts like ‘freebies offer in a manifesto of a party is not corrupt.’ According to him such judgments pave the way for individuals to be elected on malicious grounds while propagating the culture of sloppiness and impunity. Being a guardian of conducting elections; Election Commission should play its part to stop the criminalisation of politics and in carrying out performance based and purposeful elections.

Finally, in Part 3, the author confesses that it is imperative to build an accountable and responsible system of governance at Union and State level in assistance with learned judiciary if we wish for a prosperous nation. Some valuable guidelines are presented in this regard. It is a great need of time to improve secondary and tertiary resources like industries, tourism and services as well. The author also offers an idea of city centers to empower and urbanize the rural populace while creating dignified living conditions for the masses.

The most interesting aspect of the book is the retrospective approach adopted by the author with the help of newspaper clippings and legal citations. So, I rate this book 4 out of 4. Such insertions, as research tool, offer the readers to accurately verify information in support of legitimate arguments. Conspicuous conclusions are made with the help of data as prescribed through tables. Last but not the least; ‘India in Chaos, Only Judiciary can Save’ is a worth reading, well edited document that would especially appeal those who really want to inquest into the political and socio- economic dynamics of India.
