not a victim and not a cop

However, a victim and a cop might encounter me

Not a crime.

I can exist online and can be prosecuted for a criminal act if my actions harm another.

@Stephanie Runyon

A "PEER" ... as in peer pressure?

Or "BULLY"?

DATo walks slowly and tearfully down the runway toward the microphone holding a bouquet of red roses in his arms while the teeming masses on either side of the runway applaud and cheer as Bert Parks sings the Miss America song.

"I want to thank my parents who gave me life and the OnlineBookClub which gave me this wonderful opportunity. I also want to thank Stephanie Runyon for presenting such a challenging riddle and all the runner-ups who competed. During my period as Solver Of The Riddle I plan to find a solution to the crisis of world hunger, end the arms race, revitalize the world economy, and solve the problems which are causing the ecological ruin of the planet .... and then, after I complete all that .... I'M GOING TO GET MY VERY OWN APARTMENT!!!!" -DATo

NEW RIDDLE:
1) Sitting on me can make the bravest person frightened.
2) Despite the brightly colored and HaPpY decor which surrounds me you wish to be sitting on just about anything else.
3) Children can usually be heard crying and screaming when they sit on me.
4) In all other respects I can be quite comfortable.
WHAT AM I ?

Roller coaster is an excellent answer, but it is not the correct one. :cry:
